These general conditions of sale (the "General Conditions") are concluded between GARD&N SASU and any non-commercial natural person ("You") wishing to make a purchase.

These General Conditions exclusively govern your relationship with GARD&N SASU.

GARD&N SASU reserves the right to modify the General Conditions at any time. They will then be applicable as soon as they are put online.

02. Products

The products governed by these General Conditions are those which appear on the Website and which are indicated as sold and shipped by GARD&N SASU under the brand name Polhine (the "Products"). They are offered within the limits of available stocks.

The essential characteristics of the Products are described and presented with the greatest possible accuracy.

03. Price

The prices of the Products are indicated in Euros, all taxes included. They take into account the VAT and any reductions applicable on the day of the order.

The prices of the Products are exclusive of delivery costs (shipping, packaging and making up the package according to the amounts in force). The amount of the delivery costs will be specified before validation of the order.

If one or more taxes or contributions, in particular environmental, were to be created or modified, up or down, this change may be passed on to the selling price of the Products present on the Website and on the various sales media.

However, a price cannot be modified once your order has been validated. However, in the event of a price error (obviously derisory price compared to the real value of the Product), the validated order may be canceled by GARD&N SASU. This measure remains exceptional.

04. Order

4.1 Prior identification

To place an order, You must identify yourself with your email address and your personal information: surname, first name, email address and telephone number.

4.2 Registration and validation of the order

You have the possibility to place your order online from the online store.

Once your basket has been validated, You must choose the address and delivery method, and validate your means of payment, this last step formalizing the sales contract with GARD&N SASU.

Any order implies acceptance of the prices and descriptions of the Products available for sale.

GARD&N SASU will acknowledge receipt of your order as soon as it is validated by sending you an email in which you will find a link to these General Conditions.

In certain cases, in particular for non-payment, incorrect address or any other problem related to your account, GARD&N SASU reserves the right to block your order until the problem is resolved.

In case of unavailability of a Product ordered, you will be informed by email or telephone. The cancellation of the order for this Product and its possible refund will then be made, the rest of the order remaining firm and definitive.

05. Terms of payment

You can pay for your order using the Paypal and Prestashop Checkout secure payment systems. GARD&N SASU does not collect your bank details and has chosen well-known banking establishments that provide a sufficient level of security. These data are not intended to be used for commercial prospecting purposes. They may be communicated, as necessary, with regard to the purpose mentioned above to the subcontractor of banking establishments established in the European Union. The data transfers made necessary take place under conditions and under guarantees specific to ensuring the protection of your personal data.

06. Delivery

6.1. Delivery in metropolitan France.

The products are delivered with our carrier partner LA POSTE to the address indicated during the ordering process, or to the Relay point indicated by you.

In the event of late delivery by a carrier, the company GARD&N SASU cannot be held responsible for it, but of course remains at the Customer's disposal for investigation and resolution of any dispute.

6.1. International delivery delivery

For any order outside mainland France, Corsica, Monaco and DOM-TOM, You may be asked to pay customs duties and taxes to collect your Polhine order. Taxes (VAT) may also be required.

The amount of any customs duties and taxes that may be applied depends on the country, nature and origin of your shipment and therefore cannot be predicted by GARD&N SASU.

07. Return of Products

7.1. Exercise of the right of withdrawal

You have a right of withdrawal of fourteen (14) calendar days from the date of receipt or withdrawal of your entire order.

During these periods, You may return the undamaged Products, provided that you justify the reason. In the event of damaged Products received, the procedure of article 7.3 will apply.

All Products may be subject to withdrawal, except those excluded by law in Article L221-28 of the Consumer Code, for example Products that have been personalized at your request, or again the Products having been unsealed, etc.

Returned Products must be intact and complete and must not have been subject to prolonged use.

Attention, to facilitate the good recovery of the Products, the latter must be provided with their untorn protective packaging.

To exercise your right of withdrawal, You can notify us by email at hello@polhine.com, with a clear and unambiguous justification.

GARD&N SASU will acknowledge receipt of your withdrawal by email.

You must then return the Products to the Polhine workshop, no later than fourteen (14) days following your withdrawal by La Poste to the following address: Polhine, 7 rue Jean l'Evêque 08200 SEDAN. The return costs via La Poste are your responsibility (with the exception of a defective Product upon receipt, or an error by GARD&N SASU when sending the Product).

GARD&N SASU undertakes to reimburse you for all sums paid upon receipt of the Product that You have sent to us at the following address: Polhine, 7 rue Jean l'Evêque 08200 SEDAN. As an indication, it generally takes between one (1) to three (3) weeks for a return to the Polhine warehouses.

GARD&N SASU will reimburse You for the returned Products, subject to compliance with the conditions mentioned above, as well as the standard “one way” delivery costs for the latter if You return your entire order. “One-way” delivery costs with supplements are reimbursed within the limit of the standard delivery costs. It is specified that the “one way” delivery costs will be reimbursed separately.

If You do not return your entire order and keep one or more Products ordered, the amount of the "one-way" delivery costs will not be reimbursed by GARD&N SASU.

Reimbursement will be made by bank transfer or Paypal.

7.2. Exchange

You also have the option of requesting an exchange, within fourteen (14) days of receipt of the Product.

You can return the Product to be exchanged to the Polhine workshop, 7 rue Jean l'Evêque 08200 SEDAN, at your expense.

7.3. Special case of a non-compliant Product

GARD&N SASU advises you to check the Product at the time of its delivery and in the event that the Product delivered is non-compliant (Product error, defective or seriously damaged Product), to make written reservations at the latest within three (3) days following this delivery, with GARD&N SASU.

In all cases, the legal warranties will apply. Thus, the non-compliant Product delivered may only be the subject, initially, of replacement or repair. However, if the new Product received does not suit you, You may exercise, where applicable, your right of withdrawal within the time remaining to run.

For Products reported to be non-compliant within three (3) days of delivery, GARD&N SASU nevertheless allows you to exercise your right of withdrawal and obtain reimbursement for the Product pursuant to the provisions of Article 7.1, without going through repair or replacement, as provided for by the legal guarantee of conformity.

08. Evidence

The online provision of the credit card number and the final validation of the order will be worth proof of the entirety of the said order in accordance with article 1366 of the Civil Code and will be worth payment of the sums incurred by the seizure of the Products appearing on the receipt. ordered.
